Privacy Policy

1. INTRODUCTION

OpsScaler ("Company," "we," "us," or "our") operates the website located at opsscaler.com (the "Site"). This Privacy Policy ("Policy") describes how we collect, use, disclose, and safeguard information obtained through the Site. By accessing or using the Site, you ("you" or "User") consent to the practices described in this Policy.

2. INFORMATION WE COLLECT

We may collect the following categories of information:

(a) Information You Provide Directly. When you submit forms on the Site (including the contact form, charity application, or operational maturity assessment), we collect the information you voluntarily provide, which may include your name, email address, organization name, and responses to questionnaires.

(b) Automatically Collected Information. When you access the Site, we may automatically collect certain information about your device and visit, including Internet Protocol (IP) address, browser type, operating system, referring URL, and pages visited. This information is collected for security and operational monitoring.

(c) Cookies and Tracking Technologies. The Site does not use analytics trackers, advertising pixels, or third-party tracking cookies. Session cookies may be used to support basic site functionality.

3. USE OF INFORMATION

We use the information collected through the Site for purposes including, but not limited to, the following:

(a) responding to inquiries and requests submitted through the Site; (b) evaluating applications submitted to our charity program; (c) providing you with the results of the operational maturity assessment; (d) improving the Site, our services, and our methodology; (e) complying with applicable legal, regulatory, and contractual obligations; and (f) protecting the security and integrity of the Site.

4. DISCLOSURE OF INFORMATION

We may disclose information to the following categories of third parties, solely for the purposes described in this Policy:

(a) Service Providers, including Cloudflare, Inc. (hosting, content delivery, DNS, email routing), Google LLC (email delivery via Google Workspace), and Airtable, Inc. (form submission storage), each of which processes information on our behalf subject to confidentiality and data protection obligations;

(b) Legal and Regulatory Authorities, when disclosure is required by applicable law, regulation, legal process, or governmental request;

(c) Successors in Interest, in connection with a merger, acquisition, reorganization, sale of assets, or similar corporate transaction.

We do not sell, rent, lease, or trade your personal information to third parties for their marketing purposes.

5. DATA RETENTION

We retain information submitted through contact forms and charity applications indefinitely unless you request deletion. Assessment responses are retained indefinitely and linked to the email address provided. Server logs are retained for a period of thirty (30) days for security monitoring purposes. Retention periods may be extended to the extent necessary to comply with legal, regulatory, or contractual obligations.

6. YOUR RIGHTS

Depending upon your jurisdiction, you may have the right to:

(a) access the personal information we maintain about you; (b) request correction of inaccurate or incomplete personal information; (c) request deletion of your personal information, subject to exceptions for information we are required to retain; (d) object to or restrict certain processing activities; and (e) lodge a complaint with a competent supervisory authority.

7. DATA SECURITY

We implement commercially reasonable technical, administrative, and organizational measures designed to protect the information we collect from unauthorized access, disclosure, alteration, or destruction. Notwithstanding such measures, no method of transmission over the Internet or electronic storage is guaranteed to be 100% secure, and we cannot warrant absolute security.

8. CHILDREN'S PRIVACY

The Site is not directed to individuals under the age of thirteen (13), and we do not knowingly collect personal information from children. If we become aware that a child has provided personal information through the Site, we will take steps to delete that information. Parents or guardians who believe a child has provided information may contact us at contact@opsscaler.com.

9. INTERNATIONAL USERS

The Site is operated from the United States. If you access the Site from a jurisdiction outside the United States, your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Site, you consent to such transfer.

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. When we make changes, we will update the Effective Date at the top of this Policy. Material changes will be summarized in the changelog at the end of this Policy.
